1. Identity, scope, and acceptance
“The Credit Capital Group,” “we,” “us,” and “our” refer to the business operating TheCreditCapitalGroup.com. “You” refers to website visitors and persons submitting inquiries. By accessing or using the website, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the website. These Terms do not replace any separate written agreement signed by you and us.
2. What we do—and do not do
We engage in advertising, marketing, lead sourcing, business-development consulting, and referrals. We help identify businesses seeking capital or business-credit services and may introduce them to independent third-party lenders, financing companies, underwriters, brokers, credit-related service providers, or other affiliates (“Providers”). We may receive fees, commissions, or other compensation from Providers for qualified referrals, leads, or completed transactions.
We do not directly make loans, extend credit, underwrite applications, approve or deny financing, set financing terms, guarantee funding, guarantee credit-score changes, or perform a Provider's contractual services. A Provider independently determines eligibility, pricing, terms, services, documentation, and any credit or financing decision. We do not represent that every Provider is available or suitable for every applicant.
3. Independent third parties and referral agents
Providers are separate businesses and are not our employees or agents solely because we refer customers to them. Unless a separate signed agreement expressly states otherwise, participating advertisers, marketers, lead sources, and referral partners are independent businesses or independent contractors—not our employees, partners, joint venturers, or persons authorized to bind us. They may not promise approval, make financing decisions, hold themselves out as lenders, or make representations on our behalf without written authorization.
Each Provider and referral partner is responsible for its own representations, legal compliance, licenses or registrations when required, advertising, customer communications, data handling, services, and contractual obligations. Any commission, territory, marketing rules, confidentiality, non-solicitation, dispute resolution, or indemnification terms governing a referral agent must be set out in that agent's separately executed agreement. These public website Terms alone do not establish an agent's compensation or contractual relationship.
4. No guarantee; independent evaluation
Information on this website is general information and is not a commitment to lend, legal advice, tax advice, or individualized financial advice. We do not guarantee approval, funding amount, rate, term, speed, credit improvement, credit-report changes, or business outcomes. Before entering any transaction, review the Provider's terms, disclosures, fees, cancellation rights, and privacy practices and seek independent professional advice where appropriate.
5. Affiliate and commission disclosure
We may be paid by third-party Providers or affiliate programs when we generate leads, make introductions, or refer business. This financial relationship can influence which Providers we feature or introduce. We do not claim to compare every Provider in the market or to identify the objectively “best” option. Any customer fees must be separately and clearly disclosed by the party charging them before a transaction.
6. Your responsibilities
You agree to provide accurate information, use the website lawfully, refrain from impersonation, and avoid submitting another person's confidential or financial information without authority. Do not send Social Security numbers, bank credentials, full account numbers, or other sensitive financial records through ordinary email or unapproved website forms. You are responsible for independently verifying any Provider and the terms of any offer.
7. Communications and marketing consent
Submitting an inquiry permits us to respond to that inquiry using the contact information you provide. Promotional calls, automated texts, or other marketing communications requiring additional consent will be sent only when the applicable consent has been separately obtained. Consent to marketing is not a condition of obtaining information about our services. You may opt out of promotional email using an unsubscribe link or by contacting us; reply STOP to eligible text messages to opt out. Message and data rates may apply.
8. Third-party websites and services
We may link to, introduce, or transmit inquiries to third-party Providers in accordance with our Privacy Policy and applicable consent. We do not own or control third-party websites, applications, underwriting criteria, credit products, service delivery, or privacy policies. A referral does not constitute a guarantee, warranty, or endorsement of every statement or action by a Provider. Your agreement with a Provider is between you and that Provider.
9. Website availability and intellectual property
The website and its original branding, text, and layout are protected to the extent permitted by applicable law. You may use them for personal or internal business evaluation but may not reproduce our marks or impersonate our business without permission. We may modify or discontinue website features, subject to applicable law. The website is provided “as is” and “as available,” without warranties to the maximum extent permitted by law.
10. Limitation of liability
To the fullest extent permitted by applicable law, we and our owners, officers, employees, and authorized representatives are not responsible for a third-party Provider's independent underwriting decisions, service failures, representations, contract breaches, data practices, or other conduct that we did not direct or control. To the fullest extent permitted by law, we disclaim liability for indirect, incidental, consequential, special, exemplary, or punitive damages arising from website use or third-party referrals, including lost profits or lost business opportunities.
For claims arising solely from our website or referral services, and only where a monetary cap is legally enforceable, our aggregate liability will not exceed the greater of (a) the amount you paid directly to us for the service giving rise to the claim during the preceding 12 months or (b) US $100. Nothing in these Terms excludes or limits liability for our own fraud, willful misconduct, gross negligence where nonwaivable, statutory duties, or any other liability that cannot legally be excluded or limited. These Terms do not limit your rights against an independent Provider under its own agreement or applicable law.
11. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless The Credit Capital Group and its owners, officers, employees, and authorized representatives from third-party claims, losses, reasonable attorneys' fees, and expenses arising out of your unlawful use of the website, materially false information you knowingly submit, infringement of another's rights, or your breach of these Terms. This obligation applies only to the extent the claim is caused by your conduct and does not require you to indemnify us for our own negligence, misconduct, or violation of law where prohibited. Separate agent or Provider indemnities, if any, must be agreed in writing by those parties.
12. Dispute resolution; individual arbitration
Informal resolution first: Before filing a claim, you and we agree to send a written notice describing the dispute and requested resolution to support@thecreditcapitalgroup.com and attempt in good faith to resolve it for 30 days.
Arbitration: Except for disputes eligible for small-claims court, requests for temporary injunctive relief, or claims that applicable law prohibits from mandatory arbitration, disputes arising from these Terms or your use of our website or referral services will be resolved by binding arbitration on an individual basis administered by the American Arbitration Association under its applicable consumer or commercial rules, as determined by the nature of the dispute. The Federal Arbitration Act governs interpretation and enforcement of this arbitration provision where applicable. The arbitrator may award any individual relief available under applicable law. Arbitration may occur remotely when permitted by the administrator's rules; fees will be allocated under those rules and applicable law.
Class-action waiver: To the extent permitted by law, disputes must be brought individually and not as a class, collective, or representative proceeding. If the class waiver is held unenforceable for a particular claim and cannot be severed, that claim will proceed in a court of competent jurisdiction rather than class arbitration.
Opt-out: You may opt out of this arbitration agreement by emailing support@thecreditcapitalgroup.com within 30 days of your first acceptance of these Terms, with your name, contact information, and a clear statement that you opt out of arbitration. Opting out does not affect other Terms. This arbitration section does not apply to a separate signed agreement containing its own dispute-resolution terms.
13. Governing law and severability
Except where federal law or mandatory local law controls, these Terms are governed by the laws of the State of Indiana, without applying conflict-of-laws rules. For matters not subject to arbitration, venue will be in a court of competent jurisdiction in Indiana, unless applicable law requires another venue. If a provision is unenforceable, it will be limited or severed to the minimum extent necessary and the remainder will continue in effect, except as stated in the arbitration class-waiver provision.
14. Entire agreement; no oral modification
These Terms, together with the Privacy Policy incorporated by reference, constitute the entire agreement between you and us concerning your use of this website and supersede prior or contemporaneous discussions about website use. They do not supersede a separate, validly executed Provider, customer, or referral-agent contract governing that separate relationship. No employee, independent agent, or third party may orally modify these Terms or bind us to funding or credit outcomes. Any amendment to a separately signed contract must comply with that contract's amendment requirements.
15. Changes to these Terms
We may revise these Terms prospectively by posting an updated version and effective date. Material changes will be communicated when required by law. Revisions will not retroactively change arbitration rights for a dispute that arose before the revision without legally sufficient notice and consent.
